One-time Federal Bureau of Investigation Staff Member Asserts Wrongful Firing Due to LGBTQ+ Banner Display

A veteran Federal Bureau of Investigation intelligence specialist has brought a lawsuit claiming he was let go because of exhibiting a rainbow symbol in his workstation.

Based on David Maltinsky, that was employed with the bureau over a decade and a half, his termination in the past months was “unconstitutional and politically motivated”.

Court Action Alleges Free Speech Violations

The legal filing states that the bureau breached the plaintiff’s First Amendment rights and engaged in disciplinary measures in his case due to participating in protected speech.

The former specialist is asking for a judicial directive to restore his job with the FBI.

Details of the Legal Filing

The detailed filing, filed in a Washington court for the District of Columbia, claims that Maltinsky was terminated from his training last month over before exhibiting the flag in his workspace.

As stated in the filing, the Pride flag was given to Maltinsky to acknowledge his efforts to advance the bureau’s diversity initiatives.

Since childhood, my goal is serve my country and ensure the nation’s safety alongside the talented and committed personnel of the FBI,” stated the former employee.

He added, I exhibited that symbol – that previously was displayed at the Los Angeles office – not for political reasons, but as a symbol of acceptance, solidarity and impartial service.

Unexpected Dismissal Just ahead of Completion

In the past months, Maltinsky was accepted into the bureau’s agent course at Quantico, Virginia, until his “sudden termination shortly before finishing”.

The filing also claims that at some point following the presidential inauguration, an colleague raised an issue to Maltinsky’s direct supervisor regarding the exhibition of the LGBTQ+ symbol.

“Out of an abundance of caution, the plaintiff sought that the legal advisor for the local bureau assess whether the display of the symbol was permissible,” the filing noted.

It further mentioned, “The Chief Division Counsel advised Maltinsky that the display of the symbol complied with the agency’s standards.”

Notification of Dismissal

Nevertheless, on 1 October, the plaintiff was notified of his dismissal.

In a letter referenced in the lawsuit, bureau chief the director commented, I decided that you exercised bad decision-making with an inappropriate display of a political symbol in your office during your previous assignment at the Los Angeles Field Office.

In accordance with the Constitution of the Constitution, and statutes of the nation, your employment at the bureau is now ended.”

This legal action comes after another one filed in September by three former high-level bureau employees who said they had been improperly dismissed.

They alleged that the official stated he had been ordered by the White House to fire any employee participating in an inquiry concerning Donald Trump.

At the same time, the agency terminated an experienced official in November after Patel allegedly grew upset due to accounts that the FBI director used a government jet to go to a match during which his partner rendered the Star-Spangled Banner.
